Thank you for visiting the Privacy Notice of Gather Global Ltd (“Gather”). Gather values your privacy, and wants you to feel comfortable and secure doing business with us. This Privacy Notice describes our practices and governs the use of personal information we collect from you or about you through the Gather Websites, written or oral communications, or from other sources. This Privacy Notice also explains the rights you have over your personal information and how you can opt out of certain uses and disclosures of your personal information.
However, Gather does not assume any responsibility for the accuracy and/or completeness of such third party information. If you are an individual resident in a country within the European Economic Area (“EEA”) this Privacy Notice tells you about your privacy rights and how the General Data Protection Regulations (“GDPR”) law protects you. If you are an individual resident in the United Kingdom (“UK”) this Privacy Notice tells you about your privacy rights and how the General Data Protection Regulations (“GDPR”) as incorporated into the relevant UK country law protects you.
Who We Are and Websites We Own and Operate
Gather is a global research and insight business, specialising in the golfing industry, with headquarters in London, United Kingdom.
This Privacy Notice applies to the Gather Website, operating in the UK. Links within these sites could direct you to third party websites that are not owned or controlled by Gather. Gather has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites, which may employ cookies and/or collect personal information.
In addition, Gather will not and cannot censor or edit the content of any third party site. We encourage you to be aware when you leave the Gather Websites, and to read the privacy notice of each website that you visit. Gather affiliates may have their own privacy notice governing websites other than the above Gather Websites.

In this Privacy Notice, “personal information” means any information that can be used to identify you.
What Personal Information (Data) We Collect
We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:
- Identity Data includes first name, last name, username or similar identifier, gender, year of birth, nationality, and other golf-related information.
- Contact Data includes email address, telephone numbers
- Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
- Research data includes the response to any surveys that are completed
Gather collects personal information because it is necessary to enable us to deliver our surveys. Your personal information also helps us communicate with you about our latest products, special offers, sweepstakes, and other information and events you might like to know about, if you so choose. See the section below headed “How we use the information we collect” for more information.
We may also correlate the personal information you have provided with information from other sources, which may help us to develop a more targeted user profile concerning you and/or your demographic information. We may also process personal information to target specific surveys to you.
When you sign-up to receive marketing communications from us, we ask for your name and email address.
What Information We Collect and When
We collect information in three primary ways:
- You give us information: We collect information from you when you create an account with us, sign up to receive marketing communications, and complete surveys.
- We collect information automatically: We automatically collect certain types of personal information when you visit the Gather Websites. For example, we automatically collect various types of technical information when you use the Gather Websites as described in this Privacy Notice.

Whenever you send us an email, enter a contest, prize draw or competition, or other promotion, interact with us via a social networking service, or otherwise transmit information by giving us feedback or contacting us via post, email. Gather may obtain and collect your personal information, such as the following,:
- Identity Data such as your first and last name;
- Contact Data such telephone number, and email address;
- Your golfing behaviour such as ability, years playing golf;
Information We Collect Automatically
We do not automatically collect your email address, or telephone number unless you voluntarily input this information, such as when creating an account or when you participate in online surveys, contests, promotions or other activities. However, as is true of most websites, the Gather Websites collect certain information automatically and store it in log files by using cookies and other automated technologies when you interact with our websites. For more information on our use of cookies, please see below in the “Cookies” Section of this Privacy Notice.
In addition to any personal information or other information that you choose to submit to the Gather Websites, we and our third-party service providers (including content and analytics providers and advertising companies) may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the Gather Websites or one of our advertisements or other content elsewhere online (“Usage Information”). Usage Information may include the browser you are using, the URL that referred you to the Gather Websites, all of the areas within the Gather Websites that you visit, and the time of the visit, among other information. Our systems may also automatically gather information about the search terms you use on the Gather Websites and the links you select from within the Gather Websites to other areas of the web or elsewhere online. In addition, we may collect your IP address or other unique identifier of your computer, cell phone, or other device used to access the Gather Websites (collectively referred to as a “Device Identifier”). A Device Identifier is a number that is automatically assigned to your computer, your cell phone, or other device used to access the Gather Websites, and our computers identify your device by its Device Identifier. Usage Information may be non-identifying or may be associated with you and therefore identifiable. Whenever we associate Usage Information or a Device Identifier with you, as an individual and identifiable person, we will treat it as personal information.
Disabling Automated Technologies
Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, the Gather Websites currently do not alter their practices when they receive a “Do Not Track” signal from a visitor’s browser.
Chat Rooms and Forums
The Gather Websites may now or in the future include chat rooms, forums, message boards, and/or news groups. Any information that is disclosed in these areas becomes public information. You should exercise caution before disclosing your personal information via these public venues, which you do at your own risk. If you do so, you may receive unsolicited emails or “spam” from others. Gather cannot safeguard the privacy of personal information that is disclosed online in this manner.
Computer Profiles
Gather may also collect and accumulate other anonymous data that helps us understand and analyze the internet experience of our visitors. For example, we may accumulate visitor data relating to referring domain names, the type of browsers used, operating system software, screen resolutions, color capabilities, browser plug-ins, language settings, cookie preferences, search engine keywords and JavaScript enablement. If you do not register on one of the Gather websites, none of this information is personally identifiable.
Children’s Online Privacy Protection
Gather does not knowingly collect contact or personal information from children under 18. The Gather Websites are not intended to solicit information of any kind from children under 18. If we become aware that we have inadvertently received personal information from a child under the age of 18, we will delete such information from our records.
Use of Cookies
Our browser software includes a feature called “cookies.” If enabled, cookies may store small amounts of data on your computer about your visit to any of the Gather websites. Cookies assist us in tracking which of our features you visit most often and what content you may have viewed during past visits. When you re-visit the Gather websites, cookies can enable us to customize our content according to your preferences. We may use cookies to:
- keep count of return visits to the Gather websites
- accumulate and report anonymous, aggregate, statistical information on website usage
- deliver content and advertising specific to your interests or past viewing history

Use of Web Beacons
The Gather Websites and certain emails sent to opt-in consumers contain electronic images (called “pixels”, “transparent GIF files”, or “web beacons”) that allow us and our advertising partners to view and access cookies. In general, any electronic image viewed as part of a web page, including an ad banner, can act as a web beacon. A web beacon is a transparent graphic image placed on a web page or in an email, which indicates that a page or email has been viewed or that an email has been forwarded. In some cases these files are provided by our online management partner. These files enable our online management partner to recognize a unique cookie on your web browser, which in turn enables us to learn which advertisements bring users to the Gather Websites. The cookie was placed by us or by another advertiser that works with our online management partner. We may also include web beacons in HTML-formatted newsletters and other emails containing graphics that we send, so we may count the number of newsletters and emails that have been opened and read.
Advertising and Online Tracking
We may also use the web beacon and cookies to monitor your online behaviour and interests on the Gather websites and communications from Gather to tailor advertisements and other communications shown and sent to you to market our goods and services. With both cookies and web beacons, the information stored by the web beacon or cookie does not contain your name, address, telephone number, or email address. Our systems do not recognize browser “Do Not Track” signals, but several of our service providers who utilize these cookies and other tracking technologies on the Gather websites enable you to opt out from receiving this type of advertising. Use of IP Addresses
Gather does not store or record the Internet Protocol (“IP”) addresses of visitors to the Gather websites for marketing purposes, although we may store IP addresses in server logs for features such as to keep your shopping cart active, for system maintenance purposes, or to store the source location whenever someone provides Personal Information. An IP address is a number assigned to your computer whenever you access the Internet. An Internet Service Providers (“ISP”) typically assigns a random IP address at the time of your dial-up. For local area network (“LAN”), DSL, or cable modem users, an IP address may be permanently assigned to a particular computer. We cannot determine your identity solely based upon your IP address. Your IP address can, however, reveal what geographic area you are connecting from, or which ISP you are using. Finally, other websites you visit have IP addresses, and we may collect the IP addresses of those websites and their pages, but these IP addresses are never associated with Internet users.
How We Use the Information We Collect
We will only use your personal data when the law allows us to. Most commonly Gather may use your personal information in the following ways:
- To send you invites to participate in research surveys
- To send you targeted marketing emails
- Where we need to comply with a legal obligation
- to compile and/or distribute aggregate information about our website users and aggregate usage patterns
Purposes For Which We Use Your Information
We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.
Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. How We Share Your Information
Retailers
Gather will only disclose your email address to select third party brands when the email is collected via Gather, as disclosed in this Privacy Notice, and with your express permission.
Marketing
If you consented touse and disclosure of your personal information by Gather for marketing purposes, you agree that: Gather may use your personal information for marketing and survey purposes on behalf of itself and its partners (for example, indi golf, Golf breaks, Adidas, Full Swing). Gather appoints third party agents and suppliers in connection with such marketing and survey efforts. In connection with marketing activities in particular the management of mailshots marketing emails and SMS messaging relating to, prize draws, promotions, surveys and other marketing information which you may have agreed to receive or which may be of interest to you. Gather may use the following companies who provide services to Gather and to whom Gather will share your relevant information if you have consented to receive such marketing information:
- a) Mailchimp to assist with collection and management of data, selection for surveys, profiling, and the co-ordination marketing communications
- b) Conjointly and Survey Monkey to assist with survey completion and analysis and reporting of survey responses
We have agreements in place with such suppliers to ensure that your information is only used for the specific Gather purposes specified and only on behalf of Gather. These companies are prohibited from using your information for any other purpose.
Social Media Advertising and Look a Like Audiences
We shall from time to time place advertisements and promotional material on our social media channels. If you have opted in to receiving marketing material from us and agreed to allow us to profile targeted advertisements via the social medial channels we may share your email address in an encrypted format with the relevant social media channel so that they can link your social media profile you have with them so that you receive such Gather marketing materials posted on that social media channel. The Social media Channel will compare the email address provided by Gather with information you have already provided the social media channel when you subscribed to use their services in order to link. If you are registered with the social media channel no link will be made and the email information will be deleted and not used for any other purpose. The social media channel may compare your social media profile with other users of the social media channel to establish other users who have a similar profile to enable the social media channel to target Gather advertising to those other users. The Social media channel will never disclose your information to any other user without your consent, and all such use of your social media profile by the social media channel is subject to their privacy policy to which Gather has no control.
Third Party Marketing
From time to time Gather might establish a business relationship with other persons or entities whom it believes are trustworthy and whom it has asked to confirm that their privacy policies are consistent with Gather’s and where there are adequate safeguards to protect the personal information in accordance with data protection laws. These are known as Gather’s “Select Partners.” In such cases Gather might rent, exchange, share and/or cross-reference information, including personal information about you (but only where we have received your express opt in consent), that will enable such persons or entities to contact you regarding products and services that may be of interest to you. Once you’ve opted-in, you have the right to opt-out of data sharing with Select Partners as described in the “Personal Information Maintenance & Opt-Out” Section below.
If you have exercised your “opt-out,” Gather will use or disclose your personal information only as stated above, or: (1) when legally ordered to do so by a lawful subpoena or court order, (2) if you violate or breach an agreement with Gather and Gather seeks legal redress, (3) if we believe you will harm the property or rights of Gather or those of Gather’s other customers, (4) under exigent circumstances to protect the physical safety of Gather, its employees, users or the general public, or (5) to validate credit card numbers for charging for fee services where relevant, (6) where we have some other legal obligation to process your personal information, or (7) in connection with any relevant contract we have with you.
Aggregate Information
Gather may share aggregate statistical information with business partners, sponsors or other third parties. For example, we may tell an advertiser that X number of visitors visited a certain area on the Gather Websites, or that Y number of men and Z number of women filled out registration forms. Aggregated data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity therefore such information will not be treated as personal information. However, if we combine or connect Aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.
Unsolicited Emails Received by You
Gather does not send unsolicited bulk emails to anyone who has requested that we do not contact them. We send our communications only to those who have subscribed to receive them. If you have inadvertently received one of our marketing communications, or if you simply wish to stop receiving them, please follow the “unsubscribe” instructions contained in each newsletter (please see the section below headed “Personal Information Maintenance & Opt-Out”).
Your Rights & Choices About the Information We Collect
It is important that you are able to control your personal information. We are committed to providing you with control over your personal information. To the extent allowed by applicable law, you have the following rights with respect to your personal information:
Right of Access, which means your right to confirm whether we maintain any personal information concerning you in our systems and databases, what categories of personal information we store and use, purposes and legal bases of processing of your personal information, recipients, retention periods, cross-border transfers, technical and organizational measures we implement to secure privacy of your information;
Right to Data Portability, which means your right to receive a copy of personal information that you provided to us to be sent to you or a third party in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.;
Right to Rectification, which means your right to request an amendment or update to any inaccurate or incomplete personal information that we maintain about you in our systems and databases although we may need to verify the accuracy of the new data you provide to us;
Right to Restrict Processing, which means your right to request restrictions on how we use and process your personal information if you believe that Gather does not have legal bases to process your personal information or your personal information is inaccurate;
Right to Withdraw Consent, which means your right to revoke authorizations given to us on how to use and share your personal information, including disclosing your information to third-part recipients;
Right to Object, which means your right to object to using your personal information for certain purposes, including direct marketing and profiling; and
Right To Be Forgotten, which means your right to request us to delete your personal information from our systems and databases where there is no good reason for us continuing to process it. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
Please be aware that it is not always possible to completely delete, erase, or comply with your request with respect to all of your personal information from or in our systems and databases without some residual data backups because we still need to process your personal information for the purpose the data was originally collected, or we need your information to comply with legal obligations, perform contracts, resolve disputes, and for other legitimate reasons. We are also unable to delete your transactional data related to your purchases and returns because we need to keep these records as long as required by the applicable law. If we are precluded from honouring your request for erasure of your personal information, we will inform you of the reasons for the rejection. We will process all the requests within one month of receipt or within such other time as specified by applicable law. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances. Please submit your requests via the contact form on our website. For verification purposes and to protect your confidentiality, we can only respond to the requests sent from an email address that you provided to us or used when registering an account on the Gather websites.
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. Occasionally, it may take us longer than 30 days to deal with your request if your request is particularly complex or you have made a number of requests. In this case. We will notify you and keep you updated.

Personal Information Maintenance & Opt-Out
You have the right to object to processing of your personal information for marketing purposes, commonly known as opt-out requests. If you wish to opt-out of our use and/or disclosure of your personal information, you will have the option to do so when you first submit your personal information via the Gather websites and at any time thereafter. You are opting into receiving marketing communications and surveys from Gather if you check the boxes stating that you want to receive emails or marketing communications from Gather, and you are opting out if you leave the boxes unchecked. At any time thereafter, if you wish to stop receiving Gather communications please follow the “unsubscribe” instructions contained at the bottom of each email.
Retention of Your Personal Information
Your personal information may be retained by Gather for as long as the purposes for which the personal information was collected continue and require so, or if the retention is necessary for our legal or business purposes including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. Also, we may need to retain your personal information if we need to defend a legal claim or in case of a dispute. In addition, we retain the right to keep non-identifiable information related to your game performance,and survey responses. We will keep your personal information shared by you for direct marketing purposes until you notify us (by opting out) that you no longer wish to receive marketing materials from us.
International Transfers of Personal Information
When visiting the Gather websites your connection will be through and to servers located in the United Kingdom. All information you receive from us will be created on servers located in the United Kingdom and all information you provide will be maintained on web servers and systems located in the United Kingdom. By using the Gather websites and/or submitting information to us, your information will be stored and processed using the facilities and servers in the United Kingdom, and to those with whom we may share your information, to the extent allowable by law. Where legally allowed only with your explicit consent, we will affirmatively ask you for your consent
Gather has its headquarters in the United Kingdom. Information we collect from you will be transferred and processed in the United Kingdom. By using the Gather websites or providing us with any information, such information may be shared, transferred, and processed between the UK and US and other locations within the EEA as may be necessary to fulfil the purposes for which the information has been provided and where it is lawful to do so. Where legally allowed only with your explicit consent, we will affirmatively ask you for your consent.
The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR (the EU General Data Protection Regulation 2016/679) however the UK has received a finding of adequacy. When transferring your personal information outside of the country of collection for the purposes stated therein, Gather complies with the applicable laws. For the data transfer outside the European Economic Area, and UK.
We also use third parties to assist with the storage and processing of the data , for example to store data on servers dedicated for Gather use, or for processing marketing material on behalf of Gather, such as mail shots and other promotional activities, maintenance of marketing databases.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
Whenever we transfer your personal data out of the EEA or UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.
Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK or where the service providers have agreed to comply with standard contractual clauses or other EEA recognised and approved safeguards are in place.
Security
The Gather websites use physical, electronic and managerial security measures to protect the loss, misuse and alteration of information under our control.
We use Secure Socket Layer (“SSL”) connections with 128-bit encryption for certain transactions and confidential data. When you use a secure browser, all information you submit comes to us over the Internet in an encrypted form. Every secure page uses a digital certificate issued by a third-party certification authority. A “site certificate” sits on all secure pages. To view this certificate, click on the image of the closed lock or the solid key on the bottom bar of your browser window.
We monitor system and application activity logs to identify any unusual activity from authorized and/or unauthorized individuals accessing our systems and/or making changes to stored information. We regularly perform preventative system maintenance and monitoring to ensure the security of our data systems.
The Gather websites do not require you to set up a user ID and password.
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit, and you do so at your own risk. You can report network abuse and any risk of security violations to us by emailing contacting us via the website contact form.
Complaints
In the European Economic Area and UK, you have the right to lodge a complaint, if you believe your rights have been breached, to your local supervisory authority for data protection matters (you can check which your local national supervisory authority is here https://edpb.europa.eu/about-edpb/about-edpb/members_en). In the UK this is the Information Commissioner’s Office via its website at https://ico.org.uk/concerns/ or you can seek a remedy through local courts if you believe your rights have been breached. We would, however, appreciate the chance to deal with your concerns before you approach the supervisory authority so please contact us in the first instance.
Questions & Changes in Policy
We reserve the right to change or amend this Privacy Notice at any time, without notice to you, in which case we will post the amended Privacy Notice on our website. We may email you to notify you about the material changes thereto, but you should check our website to see the current Privacy Notice in effect.

Gather Golfers Panel Terms and Conditions

By participating in the Gather Golfers Panel (the “Panel”), participant (“Participant” or “you”) agrees to the following terms:
- Introduction. Gather Global Ltd (“Gather”)’s Panel is a voluntary program, whereby Gather plans to send surveys to Panel Participants to gather information related to participants’ opinions on various golf related topics. By signing up to participate in the Panel, you may receive surveys from Gather but may not be selected to participate in every survey Gather sends. The Panel program is offered at the sole discretion of Gather and these Terms and Conditions (“Terms”) govern your participation. By participating in the Panel, you agree to be bound by these Terms.
We have the right to change or modify these Terms or terminate the Panel at any time, for any reason, without prior notice. If we change the Terms, we will give you notice by posting the new Terms here. Those changes will go into effect on the “Last Updated” date shown in the revised Terms.
- Eligibility. Participants who sign up to participate in the Panel must be at least 18 years old and may not be an employee of Gather. You also may not be an immediate family member or reside in the same household as any such excluded employee. As part of determining your eligibility for participation in the Panel, Gather may request information, through the Initial Panel Registration form, described below, about how you engage with golf.
- Joining the Panel. If you meet the eligibility criteria above, you may join the Panel by completing an Initial Panel Registration form through the link provided by Gather. No purchase is required to join the Panel. You must provide true, accurate, current and complete information about yourself to participate in the Panel.
- Panel Survey Questions. As a Gather Panel member, you will be asked to participate in surveys sent by Gather and each survey may contain one or more questions which will ask you to provide a response to the question(s).
- Panel Opportunities
- Panel Sweepstakes (Prize draws): As a Panel Participant, you may from time to time be given the opportunity to enter a Gather sweepstakes (more commonly referred to as a prize Draw in the UK), or you may automatically be entered into a sweepstakes. The offering of any such sweepstakes and your participation in such sweepstakes will be governed by the official rules of any such sweepstakes which will be made available to all Participants.
- Try out Products: As a Panel Participant, you may from time to time be given the opportunity to try select products, from carefully selected golfing brands that Gather partners with. Gather may select any number of Panel Participants (in its discretion) and send to them a Product for the Panel Participant to use on the basis that the Panel Participant provides their feedback on the Product. The Panel Participant will be entitled to keep the Product free of charge in return for providing their feedback and responses to questions posed by Gather relating to the Product.
- Non-Disclosure. “Confidential Information” means all information or material disclosed or provided to you, either directly or indirectly, in writing, orally, or by inspection of tangible objects, by Gather or by any person or entity employed by or under contract with Gather in connection with the Panel. Confidential Information includes, but is not limited to, any survey questions and other information provided to you through the Panel You shall not copy or use Confidential Information for any purpose other than to participate in the Panel. You will not disclose Confidential Information to any third party without Gather’s prior written consent in each instance. Confidential Information is owned solely and exclusively by Gather and will remain the exclusive property of Gather. Gather grants no licenses, by implication or otherwise, to any patent, copyright, trademark, trade secret, or other rights by providing Confidential Information to you under this Agreement. You agree that breach of this Section would cause Gather irreparable injury for which monetary damages would not provide adequate compensation, and that in addition to any other remedy, Gather will be entitled to injunctive relief against such breach or threatened breach, without proving actual damage or posting a bond or other security. If Gather determines, in its sole discretion, that a Participant has violated this section of the Terms, Gather may remove the Participant from the Panel.
- Release. You release and waive, and agree not to bring at any time in the future, any claims or demands against Gather or its affiliates or their successors, assigns, or licensees, arising out of or relating to their participation in the Panel.
- Gather’s Use of Information. Personally identifiable information that is obtained by Gather as a result of your participation in the Panel will be used to administer the Panel and administration of the Sweepstakes (Prize draw) as set forth in these Terms and will be subject to Gather’s Privacy Policy. By participating in the Panel, you hereby agree and consent to Gather’s collection and usage of your personal information and acknowledge that you have read and accepted Gather’s Privacy Policy.
- Ownership of Feedback. Gather has not agreed to and does not agree to treat as confidential any suggestion, idea or response provided by you through participation in the Panel, and for the avoidance of doubt, all feedback provided by you through participation in the Panel is the property of and owned by Gather and you hereby agree to assign all rights and title in and to the feedback to Gather. Insofar as the rights in the feedback cannot be assigned then by uploading, posting, or submitting feedback, you grant to, and will procure the grant to Gather a perpetual irrevocable royalty free license to edit, copy, transmit, publish, display, create derivative works of, reproduce, modify, distribute, and otherwise use, modify, or distribute your feedback and a right to sublicence such usage to any person nominated by Gather . Nothing in this Agreement or in the parties’ dealings arising out of or related to this Agreement will restrict Gather’s right to use, profit from, disclose, publish, or otherwise exploit any feedback, without compensation to you, other than the rewards provided for participation in the Panel. You hereby warrant that any feedback you provide is your own independently created feedback and that you have full rights to the feedback and the feedback is not created using anyone else’s thoughts, ideas or creations or confidential information belonging to any third party.
- Acceptable Use Standards: By participating in the Panel you will be required to comply in all respects with the following acceptable use standards. These acceptable use standards apply to any material you provide as a panel member whether as part of the replies to surveys or otherwise (User Content). They also apply to any contact you make with other panel members and with Gather either directly or through any web based forums or social media.
You must comply with these standards in spirit as well as to the letter.
Gather will determine, in its discretion, whether any User Content or your use and participation in the panel breaches these acceptable use standards.
You may not participate in the Panel and use the Panel:
- In any way that breaches any local, national or international law or regulation.
- In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
- For the purpose of harming or attempting to harm minors in any way.
- To bully, insult, intimidate or humiliate any person.
- To send, knowingly receive, upload, download, share, post, use or re-use any material which does not comply with our content standards (see below).
- To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
- To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
User Content:
- Must be accurate (where it states facts).
- Only contain opinions that are genuinely held.
- Must comply with the law applicable in any country from which it is provided and any publication of such content shall be compliant with such laws.
User Content and interactions with other panel members and Gather must not:
- Be defamatory of any person.
- Be obscene, offensive, hateful or inflammatory.
- Infringe any copyright, database right or trade mark of any other person.
- Be likely to deceive any person.
- Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
- Contain illegal content or promote any illegal content or activity.
- Be in contempt of court.
- Be threatening, abusive, or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
- Be likely to harass, upset, embarrass, alarm or annoy any other person.
- Impersonate any person or misrepresent your identity or affiliation with any person.
- Give the impression that the User Content emanates from a specific source, if this is not the case.
- Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
- Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
- Be pornographic.
- Content that is abusive and which targets any of the following characteristics or incites hatred against people based on: race, religion, sex, sexual orientation, disability, gender reassignment.
- Termination, Expiration, Changes to the Panel. You may cancel your participation in the panel at any time. To do this, select “Unsubscribe” at the bottom of any panel-related communication. Alternatively, you can contact us via the details on our website. We may terminate your participation in the Panel at any time for any reason which may include, but is not limited to, if we determine that you (a) are ineligible, (b) have not participated in the Panel for an extended period of time, (c) violated any term or condition of the Panel or any applicable law or regulation, or (d) engaged in any deception, forgery, fraud, (e) you breach the Acceptable use standards (set out in paragraph 10 above), or committed any other abuse of the Panel. If you choose to “opt-out” of the Panel or your participation in the Panel is terminated by Gather in accordance with this paragraph, Gather retains the right to continue to use any feedback provided by You. If you cancel your participation in the Panel, you may rejoin the Panel. In all matters relating to the administration of the Panel, the decisions of Gather will be final. Gather reserves the right to change or cancel any aspect of the Panel at any time. If we change these Terms, we will give you notice by posting the revised Terms here. The changes will take effect on the “Last Updated” date shown in the Terms. By continuing to participate in the Panel, you are agreeing to the revised Terms.
- Miscellaneous. If any provision of this Agreement is found to be unlawful, void, or unenforceable, then that provision will be deemed severable from the Agreement and will not affect the validity or enforceability of any remaining provisions. This Agreement contains the entire understanding and agreement between the parties with respect to the subject matter of this Agreement and cannot be terminated, rescinded, or amended except by a written agreement signed by all parties.
- Data Protection Provisions for Panel members
The Provisions of this clause 13 shall apply to all personal information you provide to Gather:
- Controller. Gather Global Ltd, in relation to using the information a Panel member provides to administer the panel and related Sweepstakes, shall act as the Controller. Gather’s address is 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ
- Promotion Entities. Gather may use third parties (“Promotion Entities”) to assist with the running of Panel and sweepstakes for. For this promotion, Gather has engaged:
Gather will use 3rd party software (Conjointly, Mailchimp, or Survey Monkey) to assist with the creation, submission and collection of surveys to Panel members.
- Use of your information. By participating in the Panel and relevant Sweepstakes, the Panel member understands that their data will be shared with third parties for the purposes of administrating the Panel and or the Sweepstakes. The Information will be shared with the Promotion Entities as a processor for Gather. You are advised to review the Third Party promotion Entities privacy notices as Sponsor has no control over these entities. If the Panel member selects the ‘opt in’ check/tick box on the online entry form providing their consent to receive marketing information as specified, then their data will also be used by Gather and any named third parties for such specified marketing purposes during and after participation in the Panel and related the Sweepstakes. The Panel member has the right to opt out of receiving marketing communications at any time, by following the instructions set out in the marketing communications.
- Gather is committed to complying with the provisions of (EU) regulation No. 2016/679 of 27 April 2016 and applicable Data Protection laws including the Data Protection Act 2018 relating to the protection of individuals regarding the processing of personal data and the free movement of personal data (the “GDPR”).
- Except as otherwise contemplated in these Rules, and to the extent Panel members may otherwise elect at the time of entry, personal information collected in connection with the Panel participation and related Sweepstakes will be used by Gather and Promotion Entities for the administration of the Panel and related Sweepstakes only, and in accordance with the online privacy notice available at https://www.gathergolfers.com. All personal data of the Panel member will be treated confidentially by Gather and collected, stored, and processed only for the purpose of carrying out the administration, save that where information is contained in any feedback provided by the Panel member it may be used as indicated in paragraph 9 above. Except as detailed in paragraph (ii) and (iii) above in respect of sharing information with the Promotion Entities, personal data will not be transmitted to other third parties, unless with the consent of the Panel member or where legally permitted, including the requirement to disclose the Winner of a sweepstakes, their area of residence, and winning entry to the relevant regulatory body if challenged.
- The Panel member’s personal data provided as part of this promotion is not retained by Gather beyond the length of time required for the participation in the panel and any related sweepstakes. After this period, Gather or a Promotion Entity on Gather’s behalf may retain the Panel member’s personal data in archive for at least a two-year retention period after the end of the participation to resolve any queries or disputes in relation to the panel participation or relevant Sweepstakes and may share it with Promotion Entities for that purpose. If the Panel member has opted in to receive marketing materials in the future, then such data shall be used solely for that purpose unless and until the Panel member opts out of receiving such information.
- The Panel member has at any time the right to information about their personal data stored by Gather and to further information concerning data processing as well as to rectification, deletion, or restriction of processing. For the assertion of these rights, the Panel member may contact Gather directly, using the contact form on the website.
- The Panel member also has the right of appeal or to make a complaint at any time to a relevant supervisory authority where the Panel member lives in the UK. This is the Information Commissioner’s Office (ICO), Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF United Kingdom
You agree that any action of whatever nature arising from or relating to these Terms or the Panel will be filed only in the state or federal courts located in the County of San Diego, State of California. You consent and submit to the personal jurisdiction of such courts for the purposes of any such action. For UK panel members who are consumers nothing in this paragraph 14 shall affect or exclude any statutory rights of a consumer including the right to bring any claim or seek any redress through the courts in the country in which the Panel member resides

Gather – Sweepstake Terms and Conditions
Gather Golf Panel Sweepstakes
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE CHANCES OF WINNING.
- The Sweepstakes. The Gather Golf Panel Sweepstakes (a prize draw hereinafter referred to as the “Sweepstakes”) is subject to these Official Rules. By participating, you agree to these Official Rules and to the decisions of the Sponsor, which are final and binding in all respects.
- Sponsor. This Sweepstakes is sponsored by Gather Global Ltd, 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ (“Sponsor” or “Gather Golf”).
- Eligibility. This Sweepstakes is open to all members of the panel, who are 18 years of age or older as of the time of entry and are active members of the Gather Golf Panel (the “Panel”) as of the last day of the Promotion Period defined below. Employees of Sponsor and its affiliates, parent companies, and subsidiaries, as well as prize providers and advertising and promotion agencies (collectively, the “Sweepstakes Entities”), together with the immediate families (spouses, parents, siblings, and children) and those persons living in the same household as such employees (whether or not related), are not eligible to enter or win.
- Promotion Period. The Sweepstakes will have a defined promotion period (“Promotion Period”). Sponsor’s (or Sponsor’s designated representative’s) computer is the official timekeeper for the Sweepstakes.
- How to Enter. Panel members will be asked to complete a research survey to gain entry to the sweepstake
Entrants may be given the opportunity to opt-in to receive commercial emails from Sweepstakes Entities during the entry process but are not required to do so. Opting in to receive emails from Sponsor and/or Sweepstakes Entities will not increase an entrant’s chance of winning. For certainty, an entrant can opt out of receiving such commercial emails from the Sponsor and/or Sweepstakes Entities at any time without impacting their chance of winning in this Sweepstakes.
- Limit one (1) entry per person. Entries become the property of Sponsor and will not be returned to entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot, or sweepstakes service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. Use of multiple email accounts to enter will result in disqualification. All entries must be received and recorded during the Promotion Period to be eligible for the drawing. Proof of entry submission is not proof of receipt by Sponsor.
- Identity Disputes. In the event of a dispute over the identity of an entrant, the authorised account holder of the email address in the panel membership form used in the Sweepstakes will be deemed to be the entrant. The authorised account holder of an email address shall mean the natural person assigned to such account by the Internet access provider, online service provider, or other organisation responsible for assigning email addresses for the domain associated with such account. The potential winner may be required to provide identification sufficient to show that s/he is the authorised account holder of such email address.
- Prize. The prizes will differ based on each individual survey but the number of prizes available and the type of prize will be clearly stipulated within the email and survey
Prize(s) will be shipped to the Winner(s) at the Sponsor’s expense, if applicable, to the address provided by Winner(s). Prizes are considered compensation to the winners. All applicable taxes associated with and applicable to receipt or use of the prize (if any) are the sole responsibility of the Winner.
Please note that there is no cash award associated with any prize. Prizes are non-transferable; no substitutions or exchanges by the Winner are permitted. The Sponsor reserves the right, in its sole discretion, to substitute one or more elements of a prize for a prize of equal or greater value. The Winner may not redeem the Prize for cash value.
- Odds. Odds of winning depend on the number of panel members that complete the survey and therefore eligible entries during the Promotion Period.
- Winner Selection and Notification. On or about the first business day following the end of the Promotion Period, Sponsor or Sponsor’s representative will select one Winner by random drawing from among all eligible entries received. The Sponsor will notify the Winner be in writing (including email), within 7 days of the Draw Date, using contact details provided by the panel member in their panel membership form. If the contact details are incorrect then the Prize will be forfeited by the Winner. The Promoter is only obliged to try and contact a Winner once. Attempts to notify potential Winners will be made using email. Promoter shall have no liability for any Prize notification that is not received by a potential Winner for any reason beyond the Promoters control. Winners have 7 days from notification to accept in full the Prize and to e-mail or telephone their acceptance to Gather Golf and provided such other information as may be reasonably requested by Gather Golf. Sponsor is not responsible for any change of email address and/or telephone number of any entrant(s) and/or winner(s) which has not be properly advised to the Sponsor.
- If a potential winner (a) cannot be contacted or does not respond to a notification attempt within Seven days of notification, or a prize notification is returned as undeliverable; (b) does not timely return the Required Documents (as defined in Section 12 below); or (c) is found to be ineligible or not in compliance with these Official Rules, that potential winner will be disqualified, the prize will be forfeited, and an alternate potential winner will be selected by random drawing from among the remaining eligible entries for the corresponding Prize Pool, subject to the above requirements. For each potential winner, if Sponsor is unable to successfully identify a winner after Sponsor has attempted to notify five (5) potential winners, Sponsor may elect not to award the corresponding prize.
- Winner Verification and Required Documents. The Winner is subject to verification, including verification of residence. In order to receive a prize, the winner may be required, within the time period designated by Sponsor, to (a) present a valid photo identification issued by a, government agency (as applicable) (b) valid proof of address which is no more than 3 months old (b) complete, sign, and return to Sponsor an affidavit of eligibility and liability release; (the “Required Documents”).
Please note that no entrant is a Winner of a prize unless and until such entrant’s eligibility has been verified and such entrant has provided the Required Documents, even if that entrant’s name has been publicly posted or identified as a winner prior to completion of the verification process.
- Winners’ List. For a list of winners please send a self-addressed, stamped envelope to: Gather Global Ltd, 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ. All requests must be received no later than 60 days after the end of the Promotion Period. If the Sponsor is requested to provide details of the winner then the Sponsor shall only reveal the surname and initial and general geographic location of the winner unless the winner has expressly requested the Sponsor not to divulge any of their details. If the Sponsor is required by law to disclose the details of the winner to a government agency then it may do so but only to extent required by law.
- Trademark Attribution. The trademarks of Sponsor and Social Media Entities are the trademarks of their respective owners. Use does not imply affiliation.
- Unless otherwise specified, the following terms, conditions, and/or restrictions generally apply to Sweepstakes participation and/or prize(s):
- a) Sponsor has not made and is not responsible for, and hereby disclaims, any representation, warranty, or guaranty, express or implied, in fact or in law, relative to the prize.
- b) Social Media. Sweepstakes is in no way sponsored, endorsed, or administered by Facebook, Instagram, Pinterest, TikTok, and/or X (formerly Twitter) (each, a “Social Media Entity” and collectively, the “Social Media Entities”). By entering, you understand that you are providing your information to Sponsor and not to a Social Media Entity and agree to the respective Terms of Service and privacy policy of the relevant Social Media Entity. To sign up for a Facebook, Instagram, Pinterest, TikTok, and/or Twitter account, visit the respective website or download the mobile application. You must agree to the Terms of Service and Privacy Policy of the applicable Social Media Entity.
- c) Participation; Release. By participating in this Sweepstakes, each entrant agrees to abide by and be bound by these Official Rules, and to waive any right to claim any ambiguity or error herein or in the Sweepstakes itself, and to be bound by all actions of the Sponsor and/or Sponsor’s representative, whose decisions are binding and final on all matters related to this Sweepstakes.
- d) To the greatest extent permitted by law the Sponsor and the Prize Draw Entities, its related bodies corporate and their respective officers, employees, contractors and agents will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this Prize Draw or the use of any Prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Sponsor and the Prize Draw Entities. Notwithstanding the above nothing in these terms and conditions limits or excludes a Sponsor and the Prize Draw Entities liability for death or personal injury arising from its negligence and the limitations and exclusions referred to above only apply to the extent they are permissible under law. Nothing in these terms and conditions affect restricts limits or excludes any statutory rights of a consumer.
- e) The Sponsor and Sweepstakes Entities assume no responsibility or liability for (a) any incorrect, incomplete, or inaccurate registration or entry information, or for any faulty, failed, garbled, or jumbled electronic data transmissions; (b) failure to access any website, website feature, social media page, online entry page, or otherwise due to internet browser settings including settings blocking or limiting cookies or pop-ups, as well as choices, preferences, or settings specific to any website or social media platform; (c) any unauthorized access to, or theft, destruction, or alteration of entries at any point in the operation of this Sweepstakes; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilized in any aspect of the operation of the Sweepstakes; (e) inaccessibility or unavailability of the Internet in general; (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or result from any attempt to participate in the Sweepstakes; or (g) incomplete, lost, or late entries.
- f) Modification, Cancellation, or Suspension of Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, cancel, or suspend this Sweepstakes (or any portion of the Sweepstakes) should any cause or problem corrupt or inhibit the administration, fairness, security, or proper operation of the Sweepstakes and, if feasible in light of such situation as determined by Sponsor in its sole discretion, to select the winner in such manner as deemed fair and appropriate by Sponsor. If, in the Sponsor’s reasonable opinion, there is any suspected or actual evidence of tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right to void suspect entries and/or terminate the Sweepstakes (or any portion of the Sweepstakes) and if feasible in light of such situation as determined by Sponsor in its sole discretion select a winner using all known eligible non-suspect entries received as of the date of termination. Sponsor may prohibit entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair practices or intending to annoy, abuse, threaten, or harass any other entrant or Sponsor’s representatives. Sponsor is not responsible for typographic or printer’s errors. In no event will more than the number of prizes stated in these Official Rules be awarded.
- g) Internet and Mobile Phone Use. Please note that any normal Internet access and usage charges imposed by your Internet service provider will apply. If you use a mobile device to access the Sweepstakes entry form, your wireless service carrier’s standard charges, data rates, and other fees may apply. You understand that by participating in this Sweepstakes via mobile phone, if you are a potential winner, the Sponsor may contact you via mobile phone, which may be subject to charges pursuant to your carrier’s rate plan.
- h) Sponsor’s Use of Information. Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select the prize winner, and fulfil the prize, and will be subject to Sponsor’s privacy policy. By entering the Sweepstakes, you hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy. If you are selected as a winner, your information may also be included in a publicly available winners’ list.
